Kellogg Language in PERM Cases [Audio Seminar]

This panel will focus on alternative requirements in PERM labor certification cases and the use of Kellogg language. Discussion will include the recent adjudication trends by Department of Labor (DOL), as well as BALCA decisions on the topic. Is the DOL substituting its judgment for that of the employer in determining who is a qualified job applicant? Is DOL's recent interpretation of the Kellogg language resulting in the broadening of the employer's actual minimum requirements? Panelists will address practical tips on how employers can state alternative job requirements on the ETA-9089 as well as the ETA-9141.
