August Visa Bulletin shows Severe Retrogression for EB-3 Chinese nationals

The Department of State’s August Visa Bulletin provides some disappointing news for EB-3 Chinese nationals who now retrogress over 7 years.  As predicted, EB-2 Indians remain at a standstill.  Unused numbers in other classifications which have propelled EB-2 Indian nationals and EB-3 Chinese nationals forward these last few months have come to a stop as the State Department must ensure no more than 140,000 employment-based visas are granted for Fiscal Year 2015.  On July 17, 2015, the State Department’s visa number crunching guru Charlie Oppenheim provided some background context to our American Immigration Lawyers Association liaison committee as to what employers and employees may expect during the next few months.  Mr. Oppenheim related the EB-3 China, EB-3 India and EB-3 Philippines all have the potential to move forward a few months in September, depending on demand for EB-3 Worldwide through early August. Mr. Oppenheim predicts EB-3 Worldwide and EB-3 Mexico will continue to advance in September but may hold steady starting in October for a month or two to see if significant demand from the recent advancement of the cut-off date materializes.  Charlie predicts that EB-2 China numbers will likely hold steady for September.
