U.S. District Court Denies Request to Compel USCIS to Accept Adjustment of Status Applications Pursuant to the Original October 2015 Visa Bulletin Dates

Earlier this month, the U.S. District Court for the Western District of Washington denied the request for a temporary restraining order filed by several beneficiaries of approved employment-based visa petitions to compel the USCIS to accept applications for adjustment of status pursuant to the original October 2015 Visa Bulletin issued on 9/9/2015, and strike down the revised Visa Bulletin issued on 9/25/2015.

The District Court’s denial of the restraining order stated "While the Court appreciates the confusion caused by the two Visa Bulletins published in September and the potentially wasted expenses Plaintiffs incurred as a result, because Plaintiffs fail to meet the critical elements for a temporary restraining order at this time, the Court cannot issue injunctive relief."
