USCIS to begin returning FY H-1B Lottery Loser application packages

The FY H-1B lottery dust has begun to settle, according to the government’s announcement today. The government has completed data entry for all FY H-1B lottery winners.  As we advised before, the consolation prizes for lottery losers will be return of FY H-1B application packages, including the uncashed filing fee checks.  Due to the 233,000 FY H-1B cases filed, however, the government cautioned it could not predict when it would complete the task of returning all FY H-1B Lottery Loser application packages, but rather will issue another announcement when it has done so. 

Here’s what employers and employees may expect:

  1. For FY H-1B cases filed by Premium Processing, the government should complete adjudication by May 11, absent a Request for Evidence.
  2. Expect returned application packages to start trickling in this week and over the next two weeks.
